1. TERMS AND CONDITIONS OF GAIVOTA FRIENDS MEMBERS EXCLUSIVE:
1.1. Gaivota Friends Members Exclusive is Hotel Gaivota's loyalty program through which benefits are granted to customers of its hotel unit indicated on the website www.hotelgaivota.com as a participant in the loyalty program.
1.2. Gaivota Friends Members Exclusive is responsible for defining the hotel units to be included in this Program from among those referred to in No.1.1, and may change, at any time, the list of hotel units covered in the Program.
1.3. Individuals over 18 years of age can participate in Gaivota Friends Members Exclusive and will be assigned a login and password.
1.4. The login and password for the participation program are personal and non-transferable and cannot be transferred to a third party.
1.5. The participant must keep their contact details and profile updated in the dedicated customer area on the website www.hotelgaivota.com. Any participant may cease their participation at any time, by notifying Hotel Gaivota in writing.
2. BENEFITS
2.1. The Program provides participants with benefits, according to the levels of each GGC member. Its publication is made on the website www.hotelgaivota.com.
2.2. Hotel Gaivota reserves the right to change, with 10 days notice on the website www.hotelgaivota.com, the criteria for awarding benefits.
2.3. The website www.hotelgaivota.com contains complementary and updated information about the benefits of the Program.
2.4. The conditions for using the loyalty program discounts and benefits are as follows:
a) Discounts on accommodation: apply to the indicated rates, both the base price and the offers published on the website; package rates that have other items included do not have the Gaivota Friends Members Exclusive discount; With the aforementioned reservations, GUEST customers will be entitled to a 5% discount. Nespresso coffee machine in the accommodation: valid benefit for GUEST customers.
b) Regional tea at the accommodation: valid benefit for GUEST customers.
c) Discounts on Massages: GUEST customers will be entitled to a 5% discount.
d) 15% discount on car rental with MICAUTO: valid discount for GUEST customers.
e) 10% discount on Lagarta-Animação Turística trips: valid discount for GUEST customers.
3. CONDITIONS FOR USE OF THE BENEFITS
3.1. The identification of participants is a condition for making a reservation and using the benefits of the Program.
3.2. Gaivota Friends Members Exclusive reserves the right to refuse a reservation under the Guest Club Program if sufficient data is not provided to make the reservation.
3.3. Periodically, communication exclusively related to the Program is sent to the customer, namely, promotions, offers and other communications equally relevant to the purposes of Gaivota Friends Members Exclusive, with the aim of keeping the customer informed about the offers that they can take advantage of.
4. CANCELLATION AND CHANGES TO THE PROGRAM
4.1. Hotel Gaivota reserves the right to cancel or change the conditions of the Program, partially or completely, at any time, committing to make its best efforts to promptly inform the Program participants about the content and date of the effects of the changes.
4.2. Hotel Gaivota also reserves the right to create specific rules for this Program, according to the country or other geographic area where it applies.
4.3 Hotel Gaivota will disclose all cancellation or modification situations referred to in the previous numbers on the Gaivota Friends Members Exclusive website.
4.4. Hotel Gaivota reserves the right to cancel participation in the Gaivota Friends Members Exclusive to participants who misuse their credit and benefits.
5. DATA PRIVACY AND APPLICABLE LAW
5.1. The data collected will be processed by Gaivota Empreendimentos Turísticos Lda, with headquarters at Avenida Infante D.Henrique, nº103, 9500-764 Ponta Delgada, registered at the Conservatória de Ponta Delgada, under the unique registration and legal person number 51202182, which for these purposes assumes the role of Responsible for the Processing of Personal Data.
5.2. Participants' personal data will be kept for a period of 5 years, except if their account remains inactive for a period of 3 years, in which case Hotel Gaivota will delete their personal data for these purposes.
5.3. Participants' personal data will be processed for the purposes of loyalty and participation in the Program.
5.4. Participants may exercise their rights of access, rectification, deletion, opposition, limitation and portability, by accessing the platform available at www.hotelgaivota.com or via email at [email protected].
5.5. Participants can, at any time and free of charge, access and/or change personal data and communication preferences in their customer area.
5.6. Participants have the right to present their complaint to the National Data Protection Commission, located at Av. D. Carlos I, 134 - 1.º, 1200-651 Lisbon and with the email address [email protected].
5.7. Reading these terms and conditions does not exempt you from reading the Privacy Policy available on the page www.hotelgaivota.com.
